No bail for Aryan Khan again

Aryan Khan, Arbaaz Merchant and Munmun Dhamicha, accused in the cruise drugs case, were also denied bail on Wednesday. Aryan’s case, lodged in Arthur Road Jail since October 8, will now be heard in the Bombay High Court at 2.30 pm on Thursday.

In the High Court, Aryan’s lawyer and former Attorney General Mukul Rohatgi requested to see the arrest memo again. Rohatgi said – Aryan was wrongly arrested. The investigation of this case may continue even after he is granted bail.

Arbaaz Merchant’s lawyer Amit Desai also presented the arguments at the beginning of the hearing today. He called the arrest of the accused wrong without giving notice, while also questioning the Panchnama.

Earlier on Tuesday, the NCB had opposed Aryan’s bail, saying he could influence witnesses when he comes out. Aryan’s lawyer Rohatgi has rejected the entire theory of NCB and called him innocent. On Tuesday itself, the lawyer of Arbaaz Merchant, Aryan’s friend, had also presented his arguments before the court.

On Tuesday itself, the NDPS court had granted bail to two accused Manish Gadhian and Avin Sahu, arrested in the same case, on a surety of Rs 50,000. Both were caught on drug paddling charges. 2.5 grams of drugs were also recovered from Manish. After his bail, now the way for Aryan’s bail seems to be opening.

In the same case, in a written reply filed by NCB on Tuesday, it was said that an attempt is being made to tamper with the investigation of this case. Shahrukh Khan’s manager Pooja Dadlani is meeting with the witnesses and trying to influence the investigation. In such a situation, Aryan can also influence the witnesses on getting bail. He can even leave the country and run away.

According to the NCB, the alleged affidavit filed by Prabhakar Cell on October 23, 2021, has made it clear that attempts are being made to influence the investigation. The NCB says that why no such document was filed in any court before the hearing of the matter in the Sessions Court and the High Court. The affidavit was filed confidentially and then widely published and circulated in the media. While the matter is in court.

On the other hand, Aryan Khan has also filed an affidavit saying that he has nothing to do with the allegations of bribery against NCB. In the affidavit, Aryan has stated that he himself is not making any allegations against any person of the investigating agency. It has nothing to do with the claims and statements being made by some independent witnesses in this case. Seeing this, it is clear that Aryan has shied away from the allegations made by Nawab Malik or Prabhakar. Prabhakar is the same person who has said that there will be a deal of Rs 18 crore in the Aryan case.

Earlier, Aryan’s bail application has been rejected twice by the Special NDPS Court and the Qila Court. While rejecting the bail, the court had said, “Prima facie it appears that Aryan was continuously involved in activities related to drugs.”

The NDPS court, in its judgment, had said that even through WhatsApp chat, it appears that Aryan was in touch with the drug supplier. In this case, the court had also rejected the bail applications of Arbaaz Merchant and Munmun Dhamicha.
