Mumbai’s sessions court will now pronounce its verdict on August 20 on the bail plea of businessman Raj Kundra, husband of jailed actress Shilpa Shetty in pornography case. Till then he will have to remain in jail. The hearing on Raj Kundra’s bail plea was held on Tuesday (August 10), which has been deferred.
During this hearing, the police opposed Raj Kundra’s bail plea and told the court that giving him bail would send a wrong message to the society. The police also said that if Raj Kundra is released on bail, he may commit the same offense again and flee the country. The police have said this because Raj Kundra has UK citizenship.
In the bail plea filed by Raj Kundra, it has been said that the police had filed a charge sheet in this case in April. His name was neither in the chargesheet nor in the FIR. The petition states that the accused named in the chargesheet are out on bail. Also the magistrate’s court has earlier erred in rejecting his bail. Raj Kundra’s petition further states that the entire order is based on conjectures. The magistrate has failed to understand that there is no material against the applicant to show his alleged involvement in the alleged offense.
In response to Raj Kundra’s bail plea, Mumbai Police told the court in the hearing held on Tuesday that the offense is of serious nature. The police is still investigating the matter as to where all the videos made were uploaded. The police told the court that if the accused gets bail, he can continue to commit similar offenses by uploading obscene videos. Due to which our culture will be affected and wrong message will be sent in the society.
Police has also said that Raj Kundra is related to accused Pradeep Bakshi in this case. He also tried to contact Pradeep and later evade investigation.
Police said the possibility of the video being uploaded outside India cannot be ruled out as it is associated with the film world. The victims in the case are women from poor financial background and if the accused come out on bail, they will not be able to gather vital evidence. The court has fixed August 20 for the next hearing in the matter. Along with this, on Tuesday, the court has also rejected the anticipatory bail plea of Raj Kundra in a case registered by Mumbai Police last year related to porn content.
Let us inform that Raj Kundra was arrested on July 19. He was first put on police remand till July 27, while the fort court (Esplanade Court) later remanded him to 14 days judicial custody. Along with Raj Kundra, his IT head Ryan Thorpe’s bail plea was also to be heard. The decision on Ryan’s bail plea will now come only on August 20.
Earlier on July 28, the fort court had rejected Raj Kundra’s bail plea. The court was satisfied with the contention of the prosecution side that after his release, Raj Kundra could influence the investigation and witnesses in the case. The police also told the court that they have solid evidence against Raj Kundra and the crime branch has seized 68 adult videos from Raj Kundra’s office.
Sherlyn Chopra’s testimony can prove to be important in this whole case. Even before the arrest of Raj Kundra, Sherlyn Chopra had lodged an FIR in the month of April regarding sexual harassment on Raj. Sherlyn has been interrogated by the Mumbai Police team for an 8-hour long. During interrogation, Sherlyn has made many revelations about Raj Kundra and his relationship. The actress has also submitted her WhatsApp chat history, account details and a copy of her contract with Raj’s company. Sherlyn also alleges that she had a talk with Raj Kundra in connection with a business deal, but the two had an argument over the phone message. After this Raj Kundra came to her house and kissed her forcibly. Sherlyn tried to stop Raj Kundra, but she was also scared.
